Rail

These Terms of Service ("Terms") govern your use of Rail, an app published by Pixel Fox Studios LLC ("Pixel Fox Studios", "we", "us"). By downloading or using Rail, you agree to these Terms. If you do not agree, please do not use the app.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Rail on Apple devices you own or control, in accordance with the App Store Terms of Service and these Terms. You may not copy, modify, reverse-engineer, or redistribute the app except as permitted by law.
Rail is free to download, with an optional one-time Pro unlock of $4.99.
- Any purchase is a one-time charge to your Apple ID at confirmation.
- The purchase unlocks the described features on your account.
- You can restore your purchase on other devices signed in to the same Apple ID.
All purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple under its refund policy.
You own the content you create in Rail — your entries, notes, and settings. Because this content is stored on your device and, if you enable sync, in your own private iCloud, you are responsible for its backup (for example, via iCloud) and for keeping your device secure. We claim no ownership over your content.
You agree not to:
- Use the app for any unlawful purpose or in violation of these Terms
- Interfere with, disrupt, or attempt to gain unauthorized access to the app or its systems
- Use the app in a way that infringes the rights of others
Rail connects to third-party services to provide certain features. Your use of those services is governed by their own terms and privacy policies:
- setlist.fm (Setlist Data): Provide artist, show, and setlist information. See https://www.setlist.fm/help/terms.
Rail is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data (including any data supplied by third-party services) will always be accurate.
To the maximum extent permitted by law, Pixel Fox Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of Rail. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim.
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. Any dispute will be subject to the exclusive jurisdiction of the courts located there, except where applicable law provides otherwise.
We may update these Terms from time to time. We will post the updated Terms here and revise the "Last updated" date. Your continued use of Rail after changes take effect constitutes acceptance of the updated Terms.
